By August 8, 2010, the owners/operators of most underground storage tanks in Massachusetts are required to have their USTs and associated piping inspected by Third-Party Inspectors. Inspections must be repeated every three years.

The Massachusetts UST Board has stated that; "In accordance with 503CMR2.10(1)(b)(2), reimbursement claims for less than $5,000 will only be accepted once every 90 days. Claims greater than $5,000.00 may still be submitted once each month. No more than one Claim per month may be submitted regardless of the amount. Claims submitted that are not in compliance with this regulation will be returned to the claimant without further processing. Claimants are cautioned that in accordance with 503CMR2.10(1)(b)(1), all claims must be submitted no later than 365 days from the date of payment and that no additional allowance for time will be allowed because of the 90-day restriction noted above. Note that this does not affect claims received prior to the effective date."

On April 1, 2009 the UST Board revised 503 CMR 2.09(1)(a) by increasing the filing time for an Application for Eligibility from 180 days to 365 days of reporting a release to MassDEP and receiving a MassDEP tracking number. Over the next few months, revisions to the regulations will be prepared, a public hearing will be conducted, and final draft regulations will be submitted to the Secretary of State. Once promulgated, the revised regulations will have an effective date of April 1, 2009.

On April 1, 2009, the UST Board voted to adopt revised language for the Appendix 3 - Reimbursement Fee Schedule guidance section regarding a clarification of work required by MassDEP that is eligible for Reimbursement. A copy of the revised Appendix 3 - Reimbursement Fee Schedule can be found on the UST Regulations webpage.
